Denton was a laborer working on the Big Dig. A foreway, which is utilized in moving and positioning rebar, was missing some of it's safety clasps. The foreway had been take out of service due to saf ... ety concerns. Denton testified that he was instructed by a foreman to put the foreway back in service. While the foreway was in the process of lifting a choker, the choker became detached and struck Denton on the head. A general foreman for Trevi Icos confirmed, under oath, that he gave the order to put the foreway back in service. We received a favorable decision awarding Denton double compensation pursuant to Section 28 of M.G.L. c. 152. The case was then resolved by means of a lump sum settlement.
