Scenario Customer has developed the software on its own and has bid on a government contract to deliver this software to the government with some minor changes. Customer receives a contract from a ... government agency. The government has inserted a number of FAR and DFARS clauses in the contract that mention giving the government rights in technical data - noncommercial items and rights in noncommercial computer software and noncommercial computer software documentation Also, this is the first contract that the Customer has received from the government after years of attempting to obtain a contract and is therefore, anxious to sign Issue They are also, unsure as to what these clauses mean but know that they do not want to give the government intellectual property rights that they have developed with their own money. Customer believes that they may have to accept the contract as is.
