He was initially held in custody after the District Attorney ... 's office made a claim of "dangerousness." On the day of trial the case was dismissed despite the Asst. District Attorney's objections and efforts to exclude evidence that the alleged victim had assaulted and battered the defendant the year before. As a result of Attorney O'Malley's legal strategy, if she testified she would have incriminated herself. She invoked the 5th Amendment the case was dismissed and client was returned to freedom.
