After asking all occupants to exit the vehicle, the officers conducted a search of the motor vehicle. The officers alleged to have found a bag of marijuana in the console of the vehicle. I advised my client to wave his right to a jury trial and proceed with a bench trial. The judge determined that even if my client knew there were contraband in the vehicle, since it was not his vehicle, he did not have the intention to have dominion and control over the contraband, agreeing with my argument.
