Comm MA has Homestead exemption in Bankruptcy. My Client, (Szwyd) was beneficiary of Nominee Trust for his home. Trustee agrued MA law did not permit exemption for Trust beneficiary. That had been the ... rule for 80 yrs which was only case challenging ruling. I won in BK Ct. CH7 Trustee appealed. Bankruptcy Appellate Panel for 1st Circuit heard case. I went back to 1852 with 1st statute. 22 changes to time of filing of the Bankruptcy. I was successful b/c of the research, Brief and Oral Argument. House saved.
