I represented a mother whose parental rights had been "terminated" without a proper trial (including testimony). The Appeals Court vacated the decision and ordered a new trial.
OUTCOME: Decrees vacated, new trial ordered.
The Appeals Court agreed that the evidence was insufficient to terminate parental rights where, despite facts in dispute, the evidence admitted was comprised of documents, offers of proof, and no live ... testimony by witnesses. Even where such a protocol was suggested by the judge, and agreed to by attorneys, it "deprived the mother of the opportunity to be heard... in a meaningful manner."
