Young woman in her forties had a luteinizing ovarian cyst surgically operated on in day surgery. Gynecologist unknowingly punctured the uterus and skewered the intestine resulting in necrosis of tissu ... es and organs that the doctor failed to diagnose after the patient presented that same evening into the ER via ambulance with severe abdominal pain. Patient admitted and after a number of days the diagnosis was eventually made but it was too late for the patient who expired leaving behind her disabled husband. Plaintiff expert indicated that the puncture of the uterus was no where near the location of the cyst and that the surgery was unnecessary in addition to the failures to perform appropriate testing once the patient returned in severe pain hours following the day surgery. Settled prior to trial for the policy limits of $1,000,000.00.
