My client had gone before the Shirley Zoning Board of Appeals for a special permit to expand his pre-existing nonconforming use and he was denied. I appealed that decision to Land Court and after tria ... l, the court found for my client. The town appealed that and the Massachusetts Appeals Court found that the town's concerns about density justified the denial. The Massachusetts Supreme Judicial Court then granted my application for further appellate review and, after hearing, overturned the Appeals Court and affirmed the Land Court decision.
