Juvenile delinquency client was stopped by police who found six (6) small bags of marijuana on his person. The police charged him with possession with the intent to distribute the marijuana, which is ... a felony. The Juvenile Court Judge dismissed the case as there was insuffiicient evidence to establish probable cause that he intended to sell the marijuana. The Commonwealth appealed. The appeals Court agreed that there was not enough evidence to support the charges and affirmed the dismissal.
