ORDER GRANTING DISMISSAL
Pending ...before the Court is the government’s motion to dismiss without prejudice the indictment returned June 24, 2008, and counts 1 and 11 of the superseding indictment returned on November 19, 2008, as to the defendants Ramon Macias-Rodriguez and Nasario Macias-Rodriguez only (doc. #852). After a three-week trial, the Court granted a mistrial as to these defendants when it appeared that the jury could not reach a verdict on the charges against them. According to the government, there is no reason to believe that a new trial is any more likely to result in a verdict regarding either defendant. In its motion, the government explains that during preparation for the new trial it has been unable to obtain additional evidence or testimony against these two defendants.
Accordingly, it is ORDERED that the indictment returned June 24, 2008, and counts 1 and 11 of the superseding indictment returned on November 18, 2008, as to the defendants Ramon Macias- Rodriguez and Nasario Macias-Rodriguez only, are hereby DISMISSED without prejudice.
