OUTCOME: Through the efforts of mediation and continued settlement discussions that followed, the parties reached an amicable settlement favorable to all.

This case involved the same parties on two (2) separate construction projects in NH. The Plaintiff, our client, was engaged to perform certain demolition services on the construction projects. Certai ... n disputes among the parties arose which ultimately ended in the commencement of litigation by the Plaintiff, claiming certain liens and bond rights for monies alleged to me owed to it. The Defendant filed counterclaims. The claim was vigorously litigated by all parties.

Varanko v. Crestwood Paving Company, LLC

OUTCOME: I successfully defended the claim for the client without any award being issued to the plaintiff, despite the fact that there were technical violations of the home improvement contractor act (which the Plaintiff heaviliy relied upon).

The Plaintiff, a homeowner, filed suit against my client, a paving contractor, for alleged defects in the work and alleged damages to the home and property. The homeowner had additionally failed to pa ... y my client any money, despite having fully completed its scope of work. Litigation was filed and the claim, pursuant to an arbitration clause in the written contract, went before an arbitrator.

OUTCOME: We were able to successfully perfect our client's mechanic's lien rights and bond rights, and obtain payment on the vast majority of the construction projects from the various general contractors, owners and bonding companies.

Our Material Supplier client provided HVAC and Plumbing materials to an HVAC Subcontractor (and certain of its subsidiaries and affiliated entities) on no less than 50 construction projects in Massachu ... setts, Connecticut and Rhode Island. The HVAC Subcontractor defaulted on its agreement and failed to pay my client a substantial sum of money. To secure our client's interest, we acted swiftly to file several dozen mechanics liens in the various jurisdictions, as well as, pursue both public and private bond rights and Federal Miller Act bond claims.
