Defendant is released from custody and Commonwealth appeals. Attorney O’Brien argues in the appeals court on behalf of the defendant and the judgment allowing a new trial is affirmed. Case is placed back on the trial list and Commonwealth concedes it’s unable to go forward and dismisses the case.

New trial awarded on the assault and battery charge and Commonwealth subsequently dismisses. Attorney O’Brien appeals the improper storage conviction arguing insufficient evidence. Commonwealth concedes and appeals court vacate the judgment of guilt and enters a not guilty on defendants behalf.
