OUTCOME: Case was remanded to the trial court

Bruce and Judith Raybeck had a divorce agreement in which they agreed that his payment of alimony to her would stop if she cohabitated with an unrelated male. She moved in with, and lived with an unre ... lated male. Bruce Raybeck sought to have his alimony stopped on this basis. Despite strong evidence of cohabitation, the court below could not decide the issue, because it had no definition to work from. We argued at the New Hampshire Supreme Court for a definition for cohabitation, seeking a definition of cohabitation and a remand to the trial court. We believe this to be a case of first impression in New Hampshire.
