Think Twice Before Retaining This Attorney

My 88-year-old mother and I retained Tully Rinckey after a year and a half of dealing with dangerous snow and ice conditions, blocked ADA access and egress aisles, repeated maintenance failures, and misleading “100% maintenance-free” representations in our 55+ senior community. We hired the firm t...o advise us regarding breach of contract, fraud, discrimination, and landlord retaliation under New York Real Property Law § 223-b, and to prepare a strong demand letter. Attorney Ashleigh Rousseau billed $1,815 to review our materials, research ownership, and draft the demand. Despite having the necessary information available, the draft was addressed to a former employee, contained errors regarding ownership and recipient information, misstated portions of the timeline, and omitted significant facts and claims. The draft did not adequately address the retaliatory non-renewals, rent increase, ADA and egress issues, misleading advertising, damages, or the serious impact on our household. Instead, it largely requested clarification, future procedures, and meetings, which did not reflect the strong legal demand we understood the firm would prepare. The information was not missing. We had provided it, and Ms. Rousseau billed for reviewing it. Between her work and the supervising attorney’s billing, most of our $4,000 retainer was consumed producing a draft we could not approve. When the firm expected us to continue paying for revisions to correct the errors and omissions, we declined. Based on my experience with the accuracy, quality, and handling of the work, I cannot recommend Ashleigh Rousseau.
