John D. Cook

I am the co-leader of Barclay Damon's Intellectual Property Practice Group and the co-chair of the Intellectual Property Litigation Practice Area. For nearly 25 years, I have prosecuted and defended claims in complex intellectual property litigation matters, counseling and representing diverse clients across a wide range of industries, including telecommunications, medical devices, and consumer products, among others.

As a former federal court law clerk with extensive trial and appellate experience in courts across the country, I bring a deep understanding of courtroom dynamics and judicial decision-making to my practice. This background has been invaluable given the complexity of the matters I handle, including prosecuting claims against 22 defendants in a patent infringement case. In another, I successfully developed and executed a strategic plan in a complex dispute between a client and a competitor that played out in more than 20 different proceedings commenced in two different federal district courts, the Patent Trial and Appeal Board of the US Patent and Trademark Office (PTAB), the US Court of International Trade, the US International Trade Commission, and the US Court of Appeals for the Federal Circuit.

I draw upon my financial background to analyze complex matters and propose solutions to help my clients achieve their business goals. Working with technical and economic experts, I developed and led trial presentations for cases involving high-dollar-value damages. One example of this was leading the development and trial presentation of the damages case that culminated in a jury finding of willful patent infringement and entry of a $62 million judgment in my client's favor.

I also frequently serve as local counsel in cases venued in the US District Court for the Northern District of New York. In doing so, I share my considerable knowledge obtained from decades of experience in the court, beginning with my clerkship and continuing to this day as a member of the Local Rules Committee and a trustee of the Northern District of New York Federal Court Bar Association.
