Plaintiff purchased an automobile from Defendant Ally Motors November 19, 2016. At all times the automobile was described as an All Wheel Drive/AWD vehicle, and Plaintiff wanted an AWD vehicle for t ... heir teenage junior driver. The day after the purchase, Plaintiff had the vehicle inspected and learned that it was Rear Wheel Drive/RWD only, and immediately tried to return the vehicle for a refund. Defendant refused to accept the vehicle for return, and rebuffed efforts by Zullo to return the car. Plaintiff obtained counsel May 2017 and a 93A Consumer Protection demand letter was issued to the Defendant. A small claim was filed on the matter July 2017, and trial was held October, 2017. Judgement for the Plaintiff.
