This case involved litigation against two bar establishments that over served a customer who was visibly intoxicated. The customer left the bars and ran a red light colliding with another vehicle. Th ... e driver of the vehicle sustained a severe and permanent brain injury as a result of the accident. The insurers for the bar establishments initially denied the claims brought on behalf of the injured driver claiming the customer was not visibly intoxicated when served. The case was extensively litigated with numerous depositions of the bars' employees and owners. Several experts were retained including toxicologist, accident reconstructionist, medical experts including a neurologist, a neuropsychologist, life care planner, vocational and economic experts. Day in the life videos were prepared. The case was mediated and successfully resolved.

This case arises from a dog attack. Mother agreed to feed and let dogs out of neighbor's home while neighbor was away on vacation. Mother brought her toddler son and young daughter to neighbor's home ... . Dog charged son and bit his head when dog was let out. Mother attempted to rescue son and was attacked by dog. Daughter watched the attack and ultimately got dog to go back in the house. Insurance Company denied the claim and attempted to argue mother became the keeper of the dog and was responsible. Insurer also tried to blame son for teasing and tormenting dog with a spray bottle. A lawsuit was filed. Case was litigated against the dog owner with depositions of dog owner and her adult children who knew about the dog. Subpoena sent to veterinarian revealed prior to the incident, dog was aggressive and could not be seen at vet. Also, dog owner muzzled the dog. In addition, mother believed other family members were caring for the dog while owner was away. This was not done, and dog was left indoors except for the short times mother let dog out and gave dog food. Dog owner denied muzzling the dog and failed to notify mother of the dog's prior aggression and issues. After completing discovery, there was a demand for the policy limits outlining the evidence against the owner of the dog. Case settled for policy limits.
