N/AOUTCOME: granted on appeal
I represented Jason Guy, who was stopped at a DUI checkpoint, and charged with Driving on a Suspended License, and a vioaltion of probation for the same offense. At the Circuit Court (Trial) level, we ... filed a motion to suppress the evidence, challenging the legality of the Sheriff's checkpoint. The Judge denied our motion, but we reserved teh right to appeal, which was handled by the public defender's office. On appeal, the Second District Court overturned the judge's ruling, granted my motion, and forced the cases against Mr. Guy to be thrown out. Not only that, the District Court ruling was used to challenge DUI and other traffic checkpoints throughout the state. It was satisfying when other attorneys in other counties approached me and my colleagues to ask if we had heard about the great ruling on the Guy case.
