Clients are a young, professional husband and wife from Venezuela who had been in the United States on J-1 and J-2 visas. Both were subject to the J-1 two-year home residency requirement (also known as ... "212 (e)") and sought my assistance with filing for a J-1 waiver on their behalf. The J-1 waiver application process includes both (1) a request made to the Department of State for a 212(e) waiver recommendation; an (2) the filing and approval of Form I-612 (Application of the Two-Year Foreign Residency with USCIS. We argued that our clients were entitled to the exceptional hardships that compliance with 212(e) --in this case, an inevitable return to Venezuela-- would inflict upon my clients' infant U.S. Citizen child (their qualifying relative for the waiver).
