OUTCOME: $1,300,000 and agreement to release information
Mr. Walker represented the widow of George Smith IV who disappeared from the Royal Caribbean cruise ship, Brilliance of the Seas, during a honeymoon cruise vacation. The cruise line asserted that the ...case was governed by the Death on the Hgh Seas Act ("DOHSA"), which excludes emotional damages, and an international treaty, the Athens Convention, which contains a damage limitation of only $70,000 where the cruise ship's itinerary does not include a U.S. port. The firm retained noted forensic scientist, Dr. Henry Lee, conducted a vessel inspection, pursued an aggressive investigation, and obtained a recovery over fifteen times the damage limitation of the international treaty. The firm also avoided a confidentiality provision and obtained a concession from the cruise line to turn over confidential information, witness statements, investigation reports, and other privileged information.
