This is a family law divorce. The appellate court overturned the alimony and distribution of the marital home. On the alimony issue, we successfully argued that the court improperly imputed income to t ... he former wife. Further, when the court disposed of the home, the court failed to consider the costs associated with the distribution. The case was remanded to the trial court to fix both errors
OUTCOME: Success
We successfully represented former husband in his trial court cases and in multiple consolidated appeals. The appellate court upheld the former wife being held in indirect criminal contempt for perjury ... when she lied to the court about her address and the address of the parties’ minor child and when she refused to provide updated address information on the child. The trial judge adjudicated her in indirect criminal contempt and put her in jail for 5 days. In the next of the consolidated cases, the court gave the father uninterrupted timesharing with the child for a period of 150 days, to make up for time lost with the child. The Appellate Court held that the remedy was legal; however, the trial judge failed to include best interest language in his judgment. Notwithstanding this technicality, after the trial, custody was modified to the Former Husband. That judgment was also appealed; however, the custody award to the Former Husband was affirmed/upheld.
