May 21, 2014OUTCOME: DUI dropped by state resulted in withhold on civil infraction
Client stopped by incredibly trained DUI officer who is trained and certified to teach and train DUI investigation and roadside exercises to other officers, is a Drug Recognition Expert and had about 2 ... 3 years experience. Officer claimed wide right turn crossing four lanes and that based on driving she thought something may be wrong with driver. Upon contact officer claimed she noticed odor of alcohol and later asserted some additional alleged signs of impairment. Client was ultimately arrested after poor performance on roadside exercises and later blew 3x the legal limit. After working up case and collecting all evidence we filed a motion to suppress. Before hearing state was cocky and sure they would win. Before ruling State asked for a few minutes to review some case law. During this time, they asked my client to accept a withhold on the civil infraction of careless driving in exchange for all criminal charges being dropped. In order to avoid having to deal with a state appeal and because there were no points on her license, no conviction and no criminal disposition, client elected to take civil infraction
