On Thursday, November 19, 2015, at a hearing on the Defendant's Renewed Motion for Sanctions, the Plaintiff, FEDERAL NATIONAL MORTGAGE ASSOCIATION, INC., (FANNIE MAE) was ordered to pay sanctions in th ... e amount of $3,500.00 for its one-year delay in providing discovery responses to the Defendant's Request for Production. The Defendant defaulted on his fixed-rate note and mortgage when the loan servicers, first SUNTRUST MORTGAGE and second, SETERUS, continually force-placed flood insurance on the borrower; notwithstanding that the condominium association never let its own insurance lapse. The Plaintiff was not forthcoming about its servicers' egregious behavior in causing the borrower's default and the discovery documents that will prove the servicing violations have not been produced to date. Trial is set for early January 2016.
