Juvenile status offenders were subjected to criminal attack by older, criminal defendant juveniles in detention center. Habeas Corpus petition was brought against director of center and HRS. Petition ... was granted, although HRS was never served and therefore not subject to court's jurisdiction. As a result a new detention center was constructed in Gainesville, and classification procedures instituted so that runaways and truants were not housed with rapists and robbers and subject to attack. Attorney Jack J. Fine handled the case in trial court and successfully completed the appeal.

This was a precedent setting case in which the Court established for the first time a factual basis for the substantial certainty exception to workers comp immunity. The plaintiffs were allowed to bri ... ng a lawsuit against their employer who ordinarily would be immune. The accident involved death and brain damage to two workers involved in a dangerous chemical scale up process at an industrial company in Gainesville, Florida. This process, in which safety rules were violated in a wholesale fashion resulted in a horrible explosion. The employer sacrificed safety in an effort to make lots of money. The argument in the trial court, the briefs and the oral argument in the Supreme Court of Florida were all handled by Jack J. Fine. Unfortunately, the Florida legislature, recognizing the precedental nature of this ruling passed legislation directed to this case, making it more difficult to be compensated in the future when greedy employers sacrifice worker safety. Mr. Fine's clients were able to make a recovery and the legislation was passed after the case was decided and applied.

This case generated a great deal of media attention and resulted in better conditions in Florida correctional facilities and higher pay for correctional officers. There are several related cases with the same name in the Southern Reporter as we utilized several different theories and causes of action, resulting in separate opinions as to each of our theories, but we won them all. In the case, Circuit Judge R.A. Green, Jr. was affirmed by the First District, and thereafter, the legislature and administrative agencies involved, followed the recommendations in the report of the experts appointed by Judge Green.
