He also had IRS lia ... bility of approximately $500,000. He owned several investment properties that were undervalued. I filed a motion to strip the second lien on his home, and it was granted. He was able to keep his home and pay the first mortgage only. I negotiated the taxes with the IRS and the State of New York. He ended up paying approximately $15,000 of the $500,000 taxes owed. He surrendered his investment properties to the bank and did not have to pay any deficiency for the balance owed. The chapter 11 plan was confirmed.

OUTCOME: Court of Appeal upheld judgment
This case involved a breach of contract between a homeowner and a contractor. Rothrock Law Firm represented the contractor. The trial court awarded the contractor a judgment of punitive damages. The ... homeowner appealed. The Appellate Court upheld the judgment based on fraud in the inducement. The case raised two issues of first impression. The first was whether punitive damages could be upheld on a breach of contract case. The second issue was whether pleading the county of residence as opposed to a street address satisfied the Texas Rules of Civil Procedure. The Court ruled for the contractor on both counts.
