A lawful permanent resident filed a petition for his minor son under Section 245(I) of the INA. The son entered without inspection. The son turned 21 and also had several minor arrests. The visa tha ... t his dad filed became available when son was over 21. Under Child Status Protection Act, he is covered as a minor. He was suppose to file for residency within 1 year from the date that the visa became available in order to be treated as a minor under CSPA. He did not file within a year, but took some action during that time that was considered sufficient to meet the exception of "sought to acquire". The Immigration Judge granted permanent residency as a minor child now at the age of 31. He will be released from ICE detention.
