Mr. J., a professional truck driver, was traveling in the early morning hours along I-4 through heavy fog. A tractor trailer driver following Mr. J failed to reasonably take into account the heavy fog ... , and slammed into the back of Mr. J’s vehicle, and Mr. J. was then pushed into the tractor trailer driving in front of him. Mr. J suffered from post-traumatic headaches and stress, exasperation of a prior injury, and was unable to return to work. Early attempts at negotiating with the involved insurance companies proved fruitless. It was only after we threatened to file suit and did file suit, against both the negligent driver and the company he was representing at the time of the crash, did the insurance company come to the negotiating table to truly make our client whole. Settlement was reached shortly after filing suit.

Ms. U, a retired resident of St. Petersburg, used to enjoy her morning walks along St. Petersburg’s beautiful waterfront. Unfortunately one fall morning, another errant driver, distracted by using his ... cell phone, failed to yield the right of way to Ms. U., and struck her, throwing her to the ground, where she sustained a broken hip and severe back pain. Orthopedic intervention and surgery replaced the hip, and Ms. U is now able to ambulate again, but she will need the use of a walker for the rest of her life. After the initial policy limits of the negligent driver’s insurance ($100,000.00) were obtained, Attorney Shafer was able to discover an umbrella policy, against which the claim was also made. This case settled in a mediation just prior to suit for an additional quarter of a million dollars ($250,000.00) bringing the total recovery for Ms. G to $350,000.00.

Ms. B thought she was on the road to recovery, until she found that her own Insurance Company refused to pay her claim for UM benefits. We filed suit directly against the Insurance Company for its failure to provide these contracted for benefits, and just before trial, with the real threat of a bad faith claim being brought after a successful trial, the Insurance Company relented and finally settled the case at mediation.
