Client was a cashier at a grocery store and wrongly accused of not ringing up all items for purchase for customers. The store security officer claimed to be able to prove it by matching receipts with s...urveillance footage (that had no sound and no overt act to show criminal intent by Client). We were prepared to show that was not correct and exonerate the Client. The Court granted our Motion to Dismiss on the morning of trial.

The Client broke up with his girlfriend, taking with him a cellphone that he had purchased but let her borrow. She wanted the cellphone back, saying that it was hers because he gifted it to her. When h...e would not return the phone, she called the police and claimed that he stole her phone and was physically violent with her. Her story was not credible for a number of reasons. Felony charges were originally considered by the prosecutor, but misdemeanors were filed. The State of Florida was aware that we were going to take this to trial and dismissed the charges when the girlfriend did not want to go to trial.

OUTCOME: DNA Case - NOT GUILTY in trial by Jury
Client's step-daughter is the alleged victim. She accused him of coming into her bedroom, getting on top of her while he was naked and thrusting his exposed penis against her vaginal area for 10 minute...s. She reported this to the police 2 days later. Client fully cooperated with police, denied the accusations and voluntarily provided a DNA sample. The DNA analysis showed the presence of his DNA on the front of jeans that she was wearing when the incident occurred. The prosecutor erroneously argued that the DNA was in the crotch area of the jeans. I established through the cross-examination of the that it was 1) somewhere on the front of the jeans 2) the type of DNA was NOT semen 3) the type of DNA was otherwise unknown and 4) the DNA was actually a mixture of at least THREE persons, meaning that there was the presence of someone else in addition to the alleged Vic and Mr. Cruz.

OUTCOME: LIFE felony dismissed by prosecutor after we proved that the charges were fabricated by alleged Victim
Client charged with Armed Burglary of Dwelling with Assault or Battery, a LIFE felony. He was also charged with Criminal Mischief, Domestic Battery by Strangulation and Aggravated Assault with Deadly W...eapon. He was accused of breaking into his ex-GF's apartment and supposedly threatened her with a knife to her throat, choked her and caused damage to the apartment. He was facing a long time in prison. The Client worked with us as we were able to show that his ex-GF made up the entire thing. She had actually called him in the middle of the night and told him that he needed to come right away to get his things. Fearing that they would be thrown away, he went to her apartment. He took a cousin with him. She was mad that he did not come alone and she threatened the cousin with a knife. We were able to get witnesses, text messages, photographs and other evidence to absolutely show not only that this woman was lying, but also why. Her motivation for was anger when Client would not marry her in order to solve her immigration issues. The State Attorney's Office reviewed our evidence, agreed with us and announced a nolle prosequi (a dismissal of the case).

At trial, the Sta...te presented its case and the Court dismissed RICO, Conspiracy to Commit RICO, Trafficking in Cocaine, and Conspiracy to Traffick Cocaine charges. The Client pled to 2 remaining lesser charges and served only 1 additional year in prison.
