Mr. Palank was traveling on Amtrak (over CSX rails) to join his wife and childen on vacation. A switch on the rails, which had been installed incorrectly 10 years prior and had been improperly service ... d and inspected, failed while the Amtrak train rode over it. Paul was killed. Our investigation revealed the improper installation and maintenance, something undiscovered by the National Tranportation Safety Board and Federal Railroad Administration. We also discovered that this behavior had been tolerated for so long, that it had become part of the company culture at CSX. Although it took nearly 7 years, over $1 Million in costs, and all the way to the United States Supreme Court to bring this case to conclusion, we were honored to represent such a fine family in their pursuit for justice.
