When it voted to deny the site plan, City council stated the reason for denial was that the site plan was not li ... ke what we thought it would be like.......not exactly a legitimate reason for denial. Evidence indicates the stated reasons for denial were merely a ruse and delay tactic, and that site plan was REALLY denied because the City planned to take and use (i.e., eminent domain) Plaintiff's property as part of a larger redevelopment plan.
