Mettevelis & Rowan vs. Charter, along with a companion case in Oklahoma, established the now widely accepted prinicipal that claims for payment submitted by health care providers who failed to provide ... inadequate care constituted false claims. These cases successfully confronted the health care industry's frequent assertions that payment for services which were inadequate were not actionable under the False Claims Act. Charter Hospital fraudulently admitted hundreds of elderly patients who did not need pschiatric treatment and were unlikely to benefit from any treatment provided by Charter. Even worse, Charter transferred these seniors (many of whom were "total care" patients) from the nursing homes where their special needs were being met to a so-called "psychiatric" hopsital where their needs were not met. I would like to thank Francine & Rhea for fighting for their patients while at Charter Hospital and continuing to fight for them by coming forward with this case so that the fraud would stop. After the discovery conducted in this case, I am convinced that it prevented seniors from dying painful deaths while at Charter Hospital. This was only the second successful qui tam action filed in the Middle District of Florida. Defendants Charter Medical Corporation and Charter Hospital of St. Louis d/b/a "Charter Hospital of Orlando South" were represented by Mr. Larry Thompson of King & Spaulding. Subseuqently, President G.W. Bush nominated Mr. Thompson to be Deputy Attorney General for the United States of America and Mr. Thompson coordinated the administration's post-Enron efforts to prosecute white collar crime.
