This matter arose from a previous case involving an automobile accident where a vehicle crossed over into the opposite traffic lane and caused a grandmother and her minor grandson to crash into the veh ... icle and sustain bodily injury. The driver in the other traffic lane was at fault. Mr. Cunha represented both the grandmother and her grandson, with the consent of the minor's parents. The parties reached a pre-suit global settlement in the sum of $180,000.00 for both the minor child and his grandmother. After receiving the maximum recovery for the minor, Mr. Cunha sought to pursue an additional recovery for the grandmother by focusing on her Insurer's (Allstate's) UM Coverage. The maximum additional recovery Mr. Cunha's client could have received was $20,000 under her UM policy with Allstate. When the insurer declined to provide Mr. Cunha's client additional coverage, Mr. Cunha promptly sued Allstate. During litigation, the case settled for $17,500.00. Therefore, Mr. Cunha was able to recover the total sum of $197,500.00 for his clients.
