Carpenter with multiple prior convictions for Driving Under the Influence, including two prior felony convictions for DUI fifth or more, and facing parole violation proceedings out of state, found NOT ... GUILTY by jury. The client was facing 5 years Florida State Prison on the Florida DUI and several years prison on the parole violation in the State of Wisconsin. Civilian witnesses dialed 911 to report a drunk driver. Officers conducted a traffic stop and reported that the client had been drifting across lanes, stumbling in an alley, and appeared to be very intoxicated. The client also had a very strong odor of alcohol, glassy eyes and slurred speech. He was arrested and charged with felony DUI because of the prior convictions. During the trial, we were able to highlight certain inconsistencies and contradictions in the testimony of the state's witnesses. After a little more than 2 hours, the jury returned a verdict of not guilty. Based on the verdict, the State of Wisconsin declined to prosecute the parole violation.
