Citizen sued police officer for false arrest for violation of his 4th Amendment rights in connection with and arrest affected inside the home without a warrant or exigent circumstances. Trial court gra ... nted police officer qualified immunity. The Circuit held that the police officer violated suspect's clearly established Fourth Amendment rights, and thus was not protected by qualified immunity, in entering home in order to effect a warrantless arrest.

A claim for disability insurance benefits was denied by an insurance company. When suit was filed, the insurance company attempted to defend the case by arguing that ERISA law applies. ERISA law is f ... or more favorable to insurance companies than individuals. We challenged the defense successfully and were able to use Florida law instead. The case settled shortly thereafter.
