This case, while involving many issues, really presented an issue of first impression. What are the consequences to an attorney who represents a client that bills in excess of what the client is allow ... ed to charge for a particular service? The Court held that the attorney forfeits his or her attorney fee in this instance. This was a very important win for the insurance carriers, because it created a disincentive or attorneys to represent clients who are charging too much for the services that are being rendered.
