Our client was driving on a dark, rural road late at night with a new moon out. The railroad company had parked one of this trains at a crossing. The crossing was not marked and the train cars themselv ... es were not marked. In fact, they were painted in a matte gray paint. When our client approached the train crossing, he did not have enough time to brake and ran into the train car. He suffered severe brain injuries resulting in brain damage for the rest of his life.
