Client was driving on Hwy 19 at night when a car exiting a parking lot t-boned her. She stopped her car and got out to inspect the damage and check on the other driver. As she walked toward the other c ... ar, she stepped into a concrete culvert that was hidden in the dark and the grass. She fell onto the concrete culvert striking her rib cage and side. X-rays at the hospital showed a compression fracture in her thoracic spine. Using a "forseeability" analysis as set forth in Florida case law, I successfully argued that the driver of the car who caused the accident was responsible for the client's injuries even if they were caused by the fall rather than the impact of the car accident. The other driver's insurance company paid their policy limit to settle the case.

Client was riding her motorcycle in Daytona. As she passed through an intersection with the right of way, the driver of a car traveling in the opposite direction turned left violating her right of way ... and striking the left side of her motorcycle with the bumper of his car. Her left leg was severely injured and after several months of medical care trying to save her leg, it had to be amputated below the knee. Amazingly, her own insurance company refused to tender her meager $25,000 Underinsured Motorist Limits. Following the filing of a Bad Faith lawsuit against the insurance company, on the eve of trial, they settled for the full case value rather than the meager policy limit.
