The client was injured when her vehicle struck an escaped cow on a dark country road. Summary judgment was entered in favor of the cow owner. The appellate court affirmed the entry of summary judgment, ... but the 5th District Court of Appeal decided the case en banc. I convinced them to certify a question of importance to the Florida Supreme Court, which the court did.
OUTCOME: Summary judgment affirmed.
I convinced the Fifth District Court of Appeal to certify a question of great public importance to the Florida Supreme Court in a case involving liability for an escaped cow. Fisel v. Wynns became the ... first escaped livestock case to reach the Florida Supreme Court since 1973. Although we ultimately failed to get the motion for summary judgment overturned, I am proud that we got the case to the Florida Supreme Court.
