OUTCOME: The lineal descendants (children of decedent) received the estate property.

This was the probate of the decedent's estate. There was a marital agreement in place which excluded the surviving spouse from exercising his statutory rights to the estate. I was successful in litig ... ating this issue where the surviving spouse was unable to exercise his spousal rights.
