On December 28, 2019, our 77-year-old client was a front seated passenger who was injured in a crash when she was hit in the face with an airbag at a high rate of speed. The crash was the result of neg ... ligence by both the driver of her vehicle and that of another car. She sustained an orbital fracture of her eye and a nose fracture. She also developed visual problems and double vision together with other orthopedic injuries. As a result of the crash, she is unable to drive and needed the service of an aide. The crash left her disfigured with scarring on her face and a nerve entrapment requiring future facial surgery and scar revision. Both drivers did not have adequate coverage to secure justice for the injuries she sustained, but the client had protected herself by purchasing both uninsured motorist and an umbrella policy. Cutler Rader was recently able to secure policy limits from all drivers and achieved a settlement for the client of $987,500.

While the settlement agreement requires that the parties remain confidential, Andrew Rader, the lead counsel for the plaintiff, described the case as follows: The 44 year old female plaintiff suffer ... ed herniated disks in a 2007 accident. The plaintiff participated in physical therapy and, eventually, underwent epidural steroid injections. Approximately nine months after the accident, she was diagnosed with adrenal insufficiency. “Adrenal insufficiency” involves the body not producing enough steroid hormones, which leads to conditions such as weight gain, varying blood pressure, fatigue, immune compromise and osteoporosis. Although not initially diagnosed by the plaintiff’s doctors, Rader’s own research showed that the adrenal insufficiency most likely resulted from the steroid injections. Unfortunately, the plaintiff suffered a rare and idiosyncratic reaction to a standard and common treatment- steroid injections. This explanation was eventually adopted by the defense endocrinology expert, which paved the way to settlement. Because the adrenal insufficiency could be related back to treatment for injuries suffered in the accident, the defendant was responsible to compensate for it.

81 year old male that had a serious fall within his retirement community. He was walking by a neighbor’s condo and tripped on clay tiles that were improperly installed and against multiple city and sta ... te building codes. The neighbor installed the clay tiles on his own without obtaining the homeowners’ association approval. According to neighbors, the tiles were there for months and the homeowners association failed to take action to remove the hazard. The tiles were raised above ground ranging from ¾” to 1-5/8” in height. The client suffered a broken left wrist. He required surgery and physical therapy to rectify the damage endured. The client’s outstanding medical bills and liens totaled $35,000. The homeowner who improperly placed the tiles and the condo association were responsible for our client’s injury. We simply held them accountable.
