In June of 2011, plaintiff Kevin Freeman was parked on the shoulder of a residential street in Okaloosa County in a Dodge 2500 work truck, when Brittany L. Engle, who was attempting to apply make-up wh ... ile driving, ran into the back of Mr. Freeman’s parked vehicle at between 30-40 mph. Brittany L. Engle admitted liability, and Plaintiff sought compensatory and punitive damages. Freeman sustained injuries to the facet joints in his neck, which resulted in a headache syndrome. The jury determined that the Freemans compensatory damages totaled $482,039. The jury also returned a verdict for punitive damages of $9,500.00. State Farm Mutual Automobile Insurance Company insured the Defendant with a $50,000.00 bodily injury liability policy. Plaintiff intends to pursue recovery of the full judgment amount in a subsequent lawsuit. Defendant has filed a Motion for New Trial, renewed Motion for Directed Verdict on Punitive Damages, and Motion for Remittitur. Plaintiff has filed a Motion for Attorney’s Fees and Costs.
