Defendant North American Credit Services, Inc. (NACS) ap pealed the district court’s summary judgment in favor of Abdul Crawford on his complaint alleging that NACS violated the Fair Debt Collection ... Practices Act. NACS argues that the district court erred in granting Crawford’s motion for summary judgment because the medical bills that were the subject of NACS’s collection efforts were not a “debt” as defined in the Act, and because the Act’s “bona fide error” defense applied.

Kottler v Gulf Coast Collection Bureau - USCA11 Case: 20-12239

OUTCOME: The 11th DCA affirmed the lower court ruling in favor of our client Fern Kottler

Gulf Coast Collection Bureau, Inc., appealed the summary judgment in favor of Fern Kottler’s complaint that it violated the Fair Debt Collection Practices Act by mailing her a validation notice for a ... debt arising from an injury that was the subject of a pending worker’s compensation claim. 15 U.S.C. § 1692e(2)(A). Gulf Coast argued that Kottler suffered no concrete injury to give her standing to sue. Gulf Coast also argues that it was not liable for sending Kottler a letter that sought to verify, not to collect, a debt and that its violation of the Act was attributable to a bona fide error that absolved it from liability.

OUTCOME: Malone’s Motion for Summary Judgment [ECF No. 25] is GRANTED. 2. ARR’s Motion for Summary Judgment [ECF No. 26] is DENIED.

It is undisputed that ARR does not have any procedures in place for the collection of medical debt in Florida. ARR Dep. 59:14-19. ARR did not cite any “internal controls . . . to reduce the incidence o ... f improper debt collection. Rather, [ARR’s] procedure is to outsource its oversight task to its creditor [the Medical Center], which must report only debts that are validly due and owing.” Owen, 629 F.3d at 1276. Therefore, ARR is not entitled to a bona fide error defense.
