The third amended complaint challenging the denial raised a claim under Florida's "consistency" statute -- Sec. 163.3215, F.S.; a declaratory judgment action challenging the County's denial of the land use change, and a Bert J. Harris, Jr. Private Property Protection Act claim for $20 million in damages. The litigation spanned more than six and a half years. Mr. Minter with his paralegals defended the claim. In May 2024, the Circuit Court entered Final Summary Judgment for the County as to all claims.
