The November 1994 amendment of paragraph (D) [effective January 1, 1995] clarified that attorney fees may be included among the taxable costs upon which an order setting asid ... e a default must be conditioned. The Court of Appeals held to the contrary in Webb v. Watts (On Remand), 194 Mich App 529 (1992). The Supreme Court vacated the judgment of the Court of Appeals and dismissed the appeal in Webb for lack of a proper party defendant. 443 Mich 862 (1993).
