OUTCOME: Defnese Verdict
Steven Milligram recently obtained a verdict in favor of his school district client following a two week trial in Supreme Court.
Plaintiffs claimed that, as a result of the failure to properly superv...ise the students in the third and fourth grade at an elementary school, the infant plaintiff was subjected to sexual molestation by and with two (2) other third grade students. According to plaintiff, when he was a third grade student, another student in his class, accosted him in the third grade boys bathroom, threatening to punch him in the stomach if he did not perform or permit this other third grader perform a sexual act upon him. A third student, who was also in the third grade, was in the bathroom with plaintiff and the other student and allegedly became involved in the same type of activities. Plaintiff acknowledged that he never reported these incidents to anyone at the School District or to his family. Rather, he finally told his mother what had been occurring the day before she reported to the School District, approximately one year after the events took place.
No one ever entered the bathroom while these acts were being performed, and there never was any outcry from the bathroom.
In response to plaintiff’s claims, the School District offered proof that it a policy which was employed concerning bathroom use. Specifically, in the third grade, students were taken to the bathroom as a group twice during the school day, once in the morning after recess and a second time in the afternoon after the returned from an activity such as music or art. In addition during the classroom teaching time, one student at a time was allowed to the bathroom using a pass. After a two week trial, the jury unanimously found in favor of the school district, finding it properly supervised the students in the elementary school
