OUTCOME: After 4 years of litigation with the Trustee of the bankruptcy estate of one of Florida's largest Ponzi schemers, the cases were settled, with my client paying $0 to the Chapter 7 Trustee and the cases being dismissed against my client, with prejudice.
These are the substantively-consolidated bankruptcy cases of most of the entities related to Louis J. Pearlman, the "boy band impresario" behind musical acts such as the Backstreet Boys and N'Sync. Mr.... Pearlman, after going on the run, being caught in Indonesia and returned to U.S. custody, plead guilty to running a Ponzi scheme to the tune of approximately $350MM. He was sentenced to 360 months in federal prison. My client was a bank that made multiple loans to Mr. Pearlman and his various entities. Mr. Pearlman's Chapter 7 bankruptcy trustee sued my client in three separate adversary proceedings; as the lead bank in one case for approximately $9.3MM, and as a participant bank in two other cases, in which the trustee sought recovery of an aggregate amount of approximately $14.9MM.
