OUTCOME: At jury selection, State nolle porssed

This was a high profile murder case involving a well known community peace activist and Miami music DJ named Uncle Al [Albert Moss] who was gunned down at his home while unarmed for no justified reason ... . Darnen Watson was accused 6 years after the murder while he was in federal prison on a drug charge. His only accusers were a number of other inmates who wanted to gain substantial assistance credit from the federal authorities so their sentences would be terminated. This case took hundreds of hours of Attorney time and a mountain of work by the whole Defense Team to win.

OUTCOME: Jury Verdict Not Guilty

Defendant was charged with a Life Felony "Car Jacking with a Firearm." There was one eye-witness who was absolutely positive that she could identify the defendant. The attorney used his lengthy studi ... es on eye-witness testimony and blew the witness out of the water culminating with a not guilty verdict. He integrated psychological material, what an expert would opine if one was available for trial, and education of the jurors as to what they would need to examine in order to analyze the ultimate question: was this identification "accurate" or was it "inaccurate?" Counsel educated the jurors during Voir Dire under their role of determining credibility of witnesses. Then he used the teaching material during openning statrements and closing arguments. He continued with the testimony of the police as to the witnesses initial description of the perpetrator and how the victim's identification grew as the case progressed through depositions, witness preparation at the State Attorney's Office and pre-trail conversations with police.
