Lender attempted to foreclose on mortgage more than five years after it initially accelerated the debt and declared the full amount due. Argued that the claim was barred by the statute of limitations ... and that the dismissal without prejudice of a prior foreclosure action did not reinstate the loan or re-start the statute of limitations. The Court of Appeals agreed. This was a big victory for homeowners and condominium associations.
