Litigation
State of Florida Department of Transportation v. Daren Rubenfeld, as Trustee, and Southern Management I, Inc.
N/A
OUTCOME: 12 person jury verdict in less than 40 minutes. Client received approx. $2.8 Million Dollars.
FDOT took a portion of a shopping center for the widening of State Road 80, Southern Boulevard in West Palm Beach. FDOT built an overpass and ramp on the land that it took. FDOT asserted that the sho...pping center was better with the ramp and overpass. Jeff Cynamon, on behalf of the property owner, asserted that the shopping center had been damaged due to FDOT taking its land and building an overpass on ramp on the land that it took. Jeff Cynamon asserted that the shopping center suffered a loss of access caused by the overpass and ramp. In addition, Jeff Cynamon asserted that driveways are now too short and dangerous caused by FDOT's taking of land. Further, Jeff Cynamon asserted that the highest and best use of the shopping center has been lowered from a small impulse retail and big box destination shopping center to solely a big box destination center. Small retail stores pay substantially higher rent per square foot than big box retail. At trial, FDOT asserted the property it took was worth approximately $750,000.00. The 12 person jury took less than 40 minutes to return their verdict. The property owner received approximately $2,800,000.00. FDOT then also had to pay the property owner's expert witness fees, attorney's fees and costs in addition to the approximately $2,800,000.00, paid to the property owner.
