This Florida insurer denied my client's property damages to her home because she had not disclosed at policy inception that there had been a foreclosure filing. This is a case of first impression relat ... ive to the use of foreclosure filing in order to justify a material misrepresentation defense. We litigated this case for 4 years and eventually prevailed.
